All Bankruptcy notices sent to both debtors and credits via the snail mail, or the regular post. It is interesting to note that if THIS bankruptcy notice does not reach on time to the creditors, then a worse situation can happen since creditor is unable to attend due to late notice.

Yes, it happens before and the creditors can object for all they want but the court will not entertain such calls. To the court, it is the creditors responsiblity to get contacted promptly with updated contact information.

So, whenever the creditor is expected to receive a bankruptcy notice, they should give an address that is easily reachable on time. The option for the creditors is given to mention their preferred address even though it may not belong to them.

The option of choosing a preferred Email address, fax number or address to the creditors is given by the NCRS,i.e. National Creditor Registration Service. The Creditors can receive the paper notices by post mailed to any the addresses mentioned by them. Nowadays creditors also get receive the same notices to their email accounts if they register at the Electronic Bankruptcy Noticing system. The Creditor also has the option to the edit the address or the delivery method within 30 days after registering with the bankruptcy process.

In NCRS, the forms can be completed online or can be printed. Make sure to visit the NCRS Site registration link to download the most updated forms and procedures available.

The Creditors should make sure of monitoring their physical or email address regularly so that can handle and process the notices on time. One may also use a P.O. Box for handling the incoming posts.

There is another option to the creditors who may feel that the posts may not reach to the mentioned address registered. They can allow a person or an organization who can represent on their behalf for receiving the notices. This is allowed as according to bankruptcy code of laws, a creditor also get a chance for defense in case of not receiving the notice to the address and the bankruptcy filing a claim that it violated the hearing.

So, most of problems related too late arrival or notices due to address may be not there if the creditors register themselves with the NCRS or the EBN System. One should take consultation after receiving the notice or even not receiving the notice on time due to which the hearing time has passed away. The notices sent by the bank through mail are mostly computer generated that may not seem clear to the eye, make sure to entertain the habit of receiving notices by post.

The notices will mention all related information about the debtor and the creditors.
